ORDER
The Commission has received a petition from Shri Ajit Kumar of Delhi
Cantt stating that his RT Iapplication of 16 August 2011 filed with the Central
Public Information Officer, Union Public Service Commission, New Delhi, has
not been responded to within the time limit prescribed under the Right to
Information (RTI) Act, 2005. A copy of his RTI application is enclosed for ready
reference.
2. The Commission has decided to treat this petition as a complaint under
Section 18 of the RTI Act, 2005, and hereby directs the CPIO/Public
Information Officer, Union Public Service Commission, New Delhi, to provide the information sought by the Complainant by 27 January 2012.
3. Since the PIO has failed to respond to the RTI application mentioned
above in time, he is, therefore, required to send his explanation in writing by 31
January 2012 to Show Cause as to why a maximum penalty of Rs.25000/ for
the delay in supply of information may not be levied upon him. If no written
explanation is received from the CPIO by 31 January 2012, the Commission will
decide the case exparte and would impose the maximum penalty prescribed
under Section 20(1) of the Right to Information (RTI) Act, i.e., Rs. 25,000/,
upon the CPIO/deemed PIO. If, however, the CPIO had responded in time and
provided the desired information, please let us know at the earliest.
4. The Complainant is advised that in case he does not receive any
information from the CPIO after this order of the Commission, he may write to
the Commission against the noncompliance of the Commission’s orders.
5. The Commission ordered accordingly.
